Can a Muslim have sex with his daughter?

 

A refutation to investigating Islam's (Christian prince) claims

A certain Arab Christian who goes by the name of Christian prince has written on his website:

 

so the Quran don't consider a daughter from adultery as a daughter so how come Muslims say Allah is merciful God how he can say that she cant take her father name even or money or childe support !!! what a shame.(http://www.investigateislam.com/sex_with_daughter.htm)

 

Christian prince bases this theory of his on erroneous commentary of Qurtubi of Surah 25 verse 54 which reads:

 

YUSUFALI: It is He Who has created man from water: then has He established relationships of lineage and marriage: for thy Lord has power (over all things).

 

Christian prince argues that Islam now allows us Muslims to have sex with our daughters from adultery based on the commentary of one Muslim. Christian prince does not show that the consensus and the MAJORITY of Muslim scholars held no such belief, and believed that daughters from adultery were also forbidden for marriage for the father. Here is Ibn Kathir's tafsir who is a much higher authority than Qurtubi:

 

(And it is He Who has created man from water,) means, He created man from a weak Nutfah, then gave him shape and formed him, and completed his form, male and female, as He willed.

 

 (and has appointed for him kindred by blood, and kindred by marriage.) in the beginning, he is someone's child, then he gets married and becomes a son-in-law, then he himself has sons-in-law and other relatives through marriage. All of this comes from a despised liquid, Allah says:

 

 (And your Lord is Ever All-Powerful to do what He wills.)

 

Notice Ibn Kathir says nothing about us being allowed to marry our daughters from adultery, neither does Tabari's tafsir.

 

In fact the Quran explicitly forbids us Muslim's from marrying our own daughters:

YUSUFALI: Prohibited to you (For marriage) are:- Your mothers, daughters, sisters; father's sisters, Mother's sisters; brother's daughters, sister's daughters; foster-mothers (Who gave you suck), foster-sisters; your wives' mothers; your step-daughters under your guardianship, born of your wives to whom ye have gone in,- no prohibition if ye have not gone in;- (Those who have been) wives of your sons proceeding from your loins; and two sisters in wedlock at one and the same time, except for what is past; for Allah is Oft-forgiving, Most Merciful;-

 

PICKTHAL: Forbidden unto you are your mothers, and your daughters, and your sisters, and your father's sisters, and your mother's sisters, and your brother's daughters and your sister's daughters, and your foster-mothers, and your foster-sisters, and your mothers-in-law, and your step-daughters who are under your protection (born) of your women unto whom ye have gone in - but if ye have not gone in unto them, then it is no sin for you (to marry their daughters) - and the wives of your sons who (spring) from your own loins. And (it is forbidden unto you) that ye should have two sisters together, except what hath already happened (of that nature) in the past. Lo! Allah is ever Forgiving, Merciful.

 

SHAKIR: Forbidden to you are your mothers and your daughters and your sisters and your paternal aunts and your maternal aunts and brothers' daughters and sisters' daughters and your mothers that have suckled you and your foster-sisters and mothers of your wives and your step-daughters who are in your guardianship, (born) of your wives to whom you have gone in, but if you have not gone in to them, there is no blame on you (in marrying them), and the wives of your sons who are of your own loins and that you should have two sisters together, except what has already passed; surely Allah is Forgiving, Merciful.

 

Muhammad Al-Hilali & Muhsin Khan:

[004:023] Forbidden to you (for marriage) are: your mothers, your daughters, your sisters, your fathers sisters, your mothers sisters, your brothers daughters, your sisters daughters, your foster mother who gave you suck, your foster milk suckling sisters, your wives mothers, your step daughters under your guardianship, born of your wives to whom you have gone in - but there is no sin on you if you have not gone in them (to marry their daughters), - the wives of your sons who (spring) from your own loins, and two sisters in wedlock at the same time, except for what has already passed; verily, Allah is OftForgiving, Most Merciful.

 

Sher Ali:

[004:023] Forbidden to you are your mothers, and your daughters, and your sisters, and your fathers' sisters and your mothers' sisters and brother's daughters, and sister's daughters, and your foster mothers that have given you suck, and your foster-sisters, and the mothers of your wives, and your step-daughters, who are your wards being born of your wives to whom you have gone in - but if you have not gone in unto them, there is no blame on you - and the wives of your sons that are from your loins; and it is forbidden to you to have two sisters together in marriage, except what has already passed; surely ALLAH is Most Forgiving Merciful.

 

Palmer:

[004:023] unlawful for you are your mothers, and your daughters, and your sisters, and your paternal aunts and maternal aunts, and your brother's daughters, and your sister's daughters, and your foster mothers, and your foster sisters, and your wives' mothers, and your step daughters who are your wards, born of your wives to whom ye have gone in; but if ye have not gone in unto them, then it is no crime in you; and the lawful spouses of your sons from your own loins, and that ye form a connexion between two sisters,- except bygones,- verily, God is forgiving, merciful;

 

Arberry:

[004:023] Forbidden to you are your mothers and daughters, your sisters, your aunts paternal and maternal, your brother's daughters, your sister's daughters, your mothers who have given suck to you, your suckling sisters, your wives' mothers, your stepdaughters who are in your care being born of your wives you have been in to -- but if you have not yet been in to them it is no fault in you - and the spouses of your sons who are of your loins, and that you should take to you two sisters together, unless it be a thing of the past; God is All-forgiving, All-compassionate;

 

Khalifa:

[004:023] Prohibited for you (in marriage) are your mothers, your daughters, your sisters, the sisters of your fathers, the sisters of your mothers, the daughters of your brother, the daughters of your sister, your nursing mothers, the girls who nursed from the same woman as you, the mothers of your wives, the daughters of your wives with whom you have consummated the marriage - if the marriage has not been consummated, you may marry the daughter. Also prohibited for you are the women who were married to your genetic sons. Also, you shall not be married to two sisters at the same time - but do not break up existing marriages. GOD is Forgiver, Most Merciful.

 

Rodwell:

[004:023] Forbidden to you are your mothers, and your daughters, and your sisters, and your aunts, both on the father and mother's side, and your nieces on the brother and sister's side, and your foster-mothers, and your foster-sisters, and the mothers of your wives, and your step-daughters who are your wards, born of your wives to whom ye have gone in: (but if ye have not gone in unto them, it shall be no sin in you to marry them;) and the wives of your sons who proceed out of your loins; and ye may not have two sisters; except where it is already done. Verily, God is Indulgent, Merciful!

 

I've pasted many translations lest someone becomes desperate saying the verse does not really say daughters. Let us also read Ibn Kathir's tafsir of this verse which also includes a small part of Tabari's tafsir:

 

Degrees of Women Never Eligible for One to Marry

 

This honorable Ayah is the Ayah that establishes the degrees of women relatives who are never eligible for one to marry, because of blood relations, relations established by suckling or marriage. Ibn Abi Hatim recorded that Ibn `Abbas said, "(Allah said) I have prohibited for you seven types of relatives by blood and seven by marriage.'' Ibn `Abbas then recited the Ayah,

 

 (Forbidden to you (for marriage) are: your mothers, your daughters, your sisters...) At-Tabari recorded that Ibn `Abbas said, "Seven degrees of blood relation and seven degrees of marriage relation are prohibited (for marriage).'' He then recited the Ayah,

 

 (Forbidden to you (for marriage) are: your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters, your sister's daughters) and these are the types prohibited by blood relation

 

So it is crystal clear that Muslims cannot marry their daughters no matter what, it is banned in all circumstances. Hence the opinion of Qurtubi is wrong and is not meant to be followed. In fact the shariah law is based on two things after the Quran and the sunnah, which is Ijma, and Qiyas, Ijma being the consensus. Hence Islamic law and rulings is followed on the consensus of Islamic scholars, and the consensus of Islamic scholars say that marrying our daughters is completely forbidden, and is never allowed under any circumstances even if she is a daughter from adultery.

 

So in conclusion I send some friendly advice to Christian prince, which is that he should be a bit more honest in his future articles rather than giving a false picture and giving an opinion of a scholar who's opinion is not held by the majority of others, in fact Christian prince has committed the fallacy of appealing to authority.
